What This Means (2025 FDD)

According to the 2025 Bens Soft Pretzels Franchise Agreement, franchisees must adhere to specific operational routines and standards to maintain uniformity and protect the brand's goodwill. These include maintaining the premises in compliance with all applicable laws, regulations, and ordinances, as well as securing and maintaining all required licenses and permits. Franchisees are responsible for the control and management of their store, including hiring, discharging, and paying employees. They must also notify Bens Soft Pretzels of any claims, litigation, or proceedings affecting the business. Franchisees may be required to participate in Bens Soft Pretzels' website or other online communications.

Bens Soft Pretzels franchisees must confine their business to the preparation and sale of only approved menu items and other food and beverage products designated in writing by Bens Soft Pretzels. Franchisees must use and honor only system-wide gift cards, certificates, and checks from approved suppliers. They are also required to modernize or replace the building, premises, trade dress, equipment, and fixtures as needed to conform to the standards of new Bens Soft Pretzels stores. All signage must comply with current specifications, which may change, and franchisees are responsible for the costs of these changes.

Franchisees must also adhere to advertising and promotional material guidelines. All advertising and promotional materials must be submitted to Bens Soft Pretzels for approval before use. If Bens Soft Pretzels does not respond within 14 days, the materials are deemed unapproved. Franchisees may be required to participate in local advertising cooperatives and contribute to their programs. Franchisees must obtain written approval for all promotional and advertising materials, creative execution, and media schedules before implementation. These measures ensure that all Bens Soft Pretzels locations maintain a consistent brand image and quality, which is typical in franchise systems to protect the overall brand and customer experience.
