What This Means (2025 FDD)

According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, the Sublicensee must obtain written consent from both the Sublicensor and the Lessor before making any alterations or improvements to the premises. In this context, the Sublicensor is the entity that holds the original lease and is subleasing the property to the Sublicensee, who will operate the Bens Soft Pretzels store. The Lessor is the property owner.

If the Sublicensor and Lessor provide written consent for alterations or improvements, Bens Soft Pretzels requires the Sublicensee to restore the premises to its original condition upon request. This restoration must occur either at the request of the Sublicensor or Licensor or, if no request is made, before the end of the sublicense term.

Bens Soft Pretzels also stipulates that the Sublicensee must not use the premises in any way that would void the insurance policy or increase the insurance risk. The Sublicensee is responsible for complying with all applicable statutes, rules, orders, ordinances, and regulations, and must not violate any certificate of occupancy. Additionally, the Sublicensee must avoid any actions that could cause structural damage, diminish the value or usefulness of the premises, or create a public or private nuisance.
