What This Means (2025 FDD)
According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, franchisees are explicitly prohibited from using the Trademarks in any inappropriate manner in any media. Bens Soft Pretzels retains ownership of its Trademarks, and the franchisee's right to use them is conditional.
The agreement specifies that franchisees cannot engage in any conduct that would infringe upon, harm, or contest Bens Soft Pretzels' rights to the Trademarks or the associated goodwill. This includes using the Trademarks in a derogatory, negative, or otherwise inappropriate way across all media platforms, whether print or electronic.
This restriction ensures that the brand's image and reputation are protected. Any misuse of the Trademarks by a franchisee could damage the brand's value and potentially lead to legal repercussions for the franchisee. Prospective franchisees should understand the importance of adhering to these guidelines to maintain the integrity of the Bens Soft Pretzels brand.
