You have the right to use the following Trademarks in accordance with the terms of the Franchise Agreement:

What This Means (2025 FDD)

According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, the Franchise Agreement does include a schedule that outlines the trademarks. Specifically, Schedule B to the Franchise Agreement lists the trademarks that franchisees have the right to use, in accordance with the terms of the Franchise Agreement.

Bens Soft Pretzels retains the right to modify and change the trademarks from time to time. The franchisee must use the name BEN'S SOFT PRETZELS as the trade name of the Store and may not use any other mark or words to identify the Store without prior written consent from Bens Soft Pretzels.

The franchisee cannot make changes or substitutions to the Trademarks unless Bens Soft Pretzels directs them to in writing. In the event of improper use or infringement of the Trademarks by a third party, Bens Soft Pretzels will control all litigation and determine whether to pursue legal action. The franchisee is obligated to promptly notify Bens Soft Pretzels of any such infringement or challenges to the use of the Trademark and assist in any legal action undertaken by Bens Soft Pretzels.
