What This Means (2025 FDD)

According to Bens Soft Pretzels's 2025 Franchise Disclosure Document, a subtenant is required to pay $200 per month plus all amounts due and payable by the sublessor under the terms of the lease. This includes minimum rent, percentage rent, utilities, general real estate taxes, other taxes, common area maintenance, marketing charges, and tenants or merchants association dues.

The FDD specifies that all such amounts are due and payable ten business days prior to the date upon which the sublessor must pay them under the terms of the lease. However, the first month's rent must be paid to the sublessor concurrent with the execution of the sublease.

This means that a new Bens Soft Pretzels subtenant must be prepared to pay the first month's rent, including all applicable fees, at the time of signing the sublease agreement. Subsequent monthly payments will follow the ten-day-prior schedule. This upfront payment requirement is a critical detail for prospective subtenants to consider in their financial planning.
