According to the 2025 Bens Soft Pretzels FDD, the Acknowledgment Addendum to the Franchise Agreement does not apply to candidates or franchised restaurant businesses located in specific franchise registration states. These states include CA, HI, IL, IN, MD, MI, MN, NY, ND, RI, SD, VA, WA, and WI. This means that if a prospective franchisee is looking to open a Bens Soft Pretzels franchise in any of these listed states, the Acknowledgment Addendum will not be a part of their Franchise Agreement.

Furthermore, the FDD states that there are no restrictions or limitations regarding where consumer business may be generated for Mobile Stores. However, franchisees are not provided consumer protections, meaning consumers can visit any Bens Soft Pretzels store regardless of location. Bens Soft Pretzels retains the right to establish franchised or company-owned stores at any location, irrespective of their proximity to a franchisee's designated area.

Bens Soft Pretzels also has the right to develop or franchise Special Site locations, such as military bases, transportation facilities, sports facilities, college campuses, amusement parks, malls, and community events, regardless of their location and proximity to a franchisee's store. Additionally, Bens Soft Pretzels may operate or license others to operate Mobile Store businesses that offer the same or different menu items within a Designated Area, as detailed in the Mobile Store Addendum. A franchisee can only operate a Mobile Store Business if Bens Soft Pretzels licenses that right to them and both parties sign a Mobile Store Addendum.
