You acknowledge and agree that we will have full and complete access to the information and data entered and produced by the POS System.

You must, at all times, have at the Store Internet access with a form of high speed connection as we require and you must maintain an email account for the Store.

What This Means (2025 FDD)

According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, Bens Soft Pretzels will have full and complete access to the information and data entered and produced by the POS system. The POS system that franchisees must purchase must comply with Bens Soft Pretzels' standards and requirements, including all future updates, supplements, and modifications.

The POS System includes all hardware and software used in the operation of the store, including electronic point-of-sale cash registers and any designated software used to record and analyze sales, customer count, average check amount, customer data, labor, inventory, product usage, employee information, and tax information. The POS System will also include any credit card processing system and/or gift card processing system that Bens Soft Pretzels designates.

It is the franchisee's responsibility to ensure compliance with all laws applicable to the POS System or other technology used in the store's operation, including all data protection or security laws and PCI compliance. Franchisees may be required to license the software from Bens Soft Pretzels, an affiliate, or a third party and may also be required to pay software licensing or user fees in connection with the use of software and all other fees associated with the POS System or any other technology used in the operation of the business.
