What This Means (2025 FDD)
According to Ben Jerrys's 2025 Franchise Disclosure Document, the standards and procedures for social media usage can be found in the Manual or otherwise in writing. The franchisee must comply with these standards and procedures when using blogs, social networks like Facebook and Instagram, professional networks like LinkedIn, live blogging tools like Twitter, virtual worlds, file, audio, and video sharing sites, and other similar social networking media or tools. This applies if these platforms reference Ben Jerrys's proprietary marks, involve the Ben Jerrys system, or relate to the franchisee's Scoop Shop.
This means that Ben Jerrys franchisees need to be aware of and adhere to the guidelines set forth by the franchisor regarding their online presence and activities. These guidelines are designed to protect the brand's image and ensure consistent messaging across all platforms. It is important for franchisees to regularly check the Manual and any other written communications from Ben Jerrys to stay updated on the latest social media policies.
Failure to comply with these standards could result in a breach of the franchise agreement. Therefore, franchisees should take the time to understand and implement the social media standards and procedures provided by Ben Jerrys. This proactive approach will help maintain a positive brand image and avoid any potential conflicts with the franchisor.
