What This Means (2025 FDD)

According to Ben Jerrys's 2025 Franchise Disclosure Document, as of the date of the document, Ben Jerrys does not have any Cooperatives established. However, Ben Jerrys retains the right to designate geographical areas for establishing Cooperatives for local and regional advertising and promotion activities.

If Ben Jerrys elects to establish or authorize others to establish an advertising and marketing Cooperative, they may require franchisees to contribute a specified amount each month. If a mandatory Cooperative exists for the area where a franchisee's shop is located, membership is required within 30 days.

Franchisees will not be required to be a member of more than one Cooperative, but if a franchisee owns multiple shops in different areas, those shops may be in different Cooperatives. Each Cooperative's organization and governance must be approved by Ben Jerrys in writing, and it will operate exclusively to administer regional advertising programs and develop standardized promotional materials for local advertising and promotion, subject to Ben Jerrys's approval.
