What This Means (2025 FDD)
According to Ben Jerrys's 2025 Franchise Disclosure Document, the 'System' refers to the distinctive methods and characteristics associated with establishing and running retail frozen dessert businesses under the Ben Jerrys brand. This system is what defines the Ben Jerrys franchise and what franchisees are expected to replicate.
The distinguishing characteristics of the Ben Jerrys system include specific elements that create a consistent brand experience. These include the distinctive exterior and interior design of the shops, including decor, color schemes, fixtures, and furnishings. It also encompasses the standards and specifications for the products sold, the equipment used, and the materials and supplies necessary for operation. Furthermore, the system includes uniform standards, specifications, and procedures for how the business operates daily, along with training, ongoing assistance, and marketing and promotional programs.
Ben Jerrys retains the right to modify and improve the System over time. This means franchisees must stay updated with any changes to maintain uniformity across all locations. For a prospective franchisee, understanding and adhering to the System is crucial, as it represents the core of the Ben Jerrys brand and operational standards. The franchise agreement grants the franchisee the right to use this system, but also obligates them to follow it, ensuring consistency and quality across all Ben Jerrys locations.
