What This Means (2025 FDD)

According to Ben Jerrys's 2025 Franchise Disclosure Document, the alternative dispute resolution (ADR) process begins with the Complainant, who is the party seeking to resolve a dispute. To initiate negotiation proceedings, the Complainant must send a certified or registered letter to the Respondent, the party with whom they are trying to resolve the dispute.

The letter must include specific details about the dispute, identify the relevant terms of the Ben Jerrys agreement (if any), and propose a resolution to the dispute. This initial letter serves as the formal start to the ADR process, outlining the Complainant's position and desired outcome.

All aspects of the ADR process are to be treated as confidential and are not admissible in any other proceeding or legal action. This confidentiality provision encourages open and honest communication between the parties, as they can explore potential resolutions without fear of their statements being used against them in future litigation.
