What This Means (2025 FDD)
According to Belocal's 2025 Franchise Disclosure Document, in the event of the death or disability of a franchisee or principal, their representative is required to appoint a manager for the franchised business within a reasonable timeframe, not exceeding 30 days from the date of death or disability. This requirement applies unless a manager was previously appointed and remains responsible for the business's daily operations.
The appointed manager must fulfill certain obligations, including completing Belocal's standard training program at the franchisee's expense. Additionally, the manager is required to sign Belocal's confidentiality and non-solicitation agreement and comply with any other requirements Belocal has for manager acceptance at that time.
Belocal also retains the option, but not the obligation, to assume management of the franchised business or appoint a third party to do so until the transfer of the business is completed. This transfer must occur within six months of the death or disability, unless Belocal grants a written extension. This provision ensures the continued operation of the Belocal franchise in accordance with the franchise agreement, while also providing a pathway for the transfer of ownership or control in unforeseen circumstances.
