Can Belocal or its affiliates establish pricing requirements for publishing and advertising rates communicated by Belocal franchisees?
Belocal Franchise · 2025 FDDAnswer from 2025 FDD Document
We and/or our affiliate reserve the right, to the fullest extent allowed by applicable law, to establish maximum, minimum, or other pricing requirements with respect to the publishing and advertising rates you communicate to potential advertisers.
All products and services contracts and advertising and publishing contracts with advertisers, recipients of the Publication, or other parties are with us or our affiliate, not with you. You may not enter into advertising or publishing contracts on our or our affiliate's behalf, and we or our affiliate(s) are the party to any advertising or publishing contract, not you.
We and our affiliates retain all rights to offer and sell – and to grant others with the license to offer and sell – digital marketing services and advertisements and to operate digital publications. We also retain the rights to require you to sell packages of advertising goods and services to clients, which may include digital components. We have the right to change or rescind this policy for any reason, and at any time, in our sole discretion.
You must participate in any Corporate Ad programs or other programs we require generally for Franchised Businesses. If you are permitted to call on Strategic Partners in your Territory and attempt to sell advertising to them for the Publication, you must strictly comply with all of our requirements relating to these relationships, including honoring any pricing arrangement agreed to between us and each such Strategic Partner.

What This Means (2025 FDD)
According to Belocal's 2025 Franchise Disclosure Document, Belocal and its affiliates retain significant control over pricing for advertising services. Belocal explicitly states that they reserve the right to establish maximum, minimum, or other pricing requirements for the publishing and advertising rates that franchisees communicate to potential advertisers. This means that as a Belocal franchisee, you may not have full autonomy in setting your own advertising rates.
This control extends to all advertising and publishing contracts, which are made with Belocal or its affiliate, not the franchisee. Franchisees are explicitly prohibited from entering into advertising or publishing contracts on behalf of Belocal or its affiliates. This arrangement centralizes control over pricing and contract terms with Belocal, potentially limiting a franchisee's ability to negotiate deals independently.
Furthermore, Belocal has the right to require franchisees to sell packages of advertising goods and services that may include digital components. Belocal can change or rescind this policy at any time at their sole discretion. Franchisees must also participate in any Corporate Ad programs or other programs Belocal requires generally for Franchised Businesses. If franchisees are permitted to call on Strategic Partners in their Territory and attempt to sell advertising to them for the Publication, they must strictly comply with all of Belocal's requirements relating to these relationships, including honoring any pricing arrangement agreed to between Belocal and each such Strategic Partner.
These stipulations are important for prospective franchisees to consider, as they could impact profitability and the ability to compete effectively in the local market. Franchisees should inquire about the specific pricing guidelines and the extent to which they can influence advertising rates within their territory.
