Can Beggars Pizza use data obtained from the franchisee in any manner?

- 8.5 Data.
All data provided by Franchisee, uploaded to Franchisor's system from Franchisee's system, downloaded from Franchisee's system to Franchisor's system, and/or obtained electronically or otherwise from Franchisee by Franchisor, is and will be owned exclusively by Franchisor, and Franchisor may use such data in any manner that Franchisor deems appropriate without compensation to Franchisee.
In addition, all other data created or collected by Franchisee in connection with the System, or in connection with Franchisee's operation of the Restaurant (including, without limitation, consumer and transaction data), is and will be owned exclusively by Franchisor during the term of, and following termination or expiration of, the Agreement.
Copies and/or originals of such data must be provided to Franchisor upon Franchisor's request.
Franchisor hereby licenses use of such data back to Franchisee, at no additional cost, solely for the term of the Agreement and solely for Franchisee's use in connection with the establishment and operation of the Restaurant pursuant to the Agreement.
- 8.6 Privacy.
Subject to applicable law, Franchisor may, from time to time, specify in the Manual (or otherwise in writing) the information that Franchisee must collect and maintain on the Computer System installed at the Restaurant, and Franchisee must provide to Franchisor such reports as Franchisor may reasonably request from the data so collected and maintained.
All data pertaining to or derived from the Restaurant (including, without limitation, data pertaining to or otherwise about customers) is and will be the exclusive property of Franchisor, and Franchisor hereby grants a royalty-free nonexclusive license to Franchisee to use said data during the term of the Agreement.
Franchisee must abide by all applicable laws pertaining to the privacy of consumer, employee, and transactional information.
Franchisee will not publish, disseminate, implement, revise, or rescind a data privacy policy without Franchisor's prior written consent as to said policy.

What This Means (2025 FDD)
According to Beggars Pizza's 2025 Franchise Disclosure Document, Beggars Pizza has broad rights regarding data obtained from franchisees. Beggars Pizza owns all data provided by, uploaded from, or downloaded to the franchisee's systems, as well as data obtained electronically or otherwise. This includes consumer and transaction data created or collected by the franchisee in connection with the Beggars Pizza system or the operation of the restaurant.
Beggars Pizza can use this data in any manner it deems appropriate without compensating the franchisee. However, Beggars Pizza licenses the use of such data back to the franchisee at no additional cost, but only for the term of the agreement and solely for the franchisee's use in connection with operating the restaurant. Franchisees must also provide copies or originals of such data to Beggars Pizza upon request.
Furthermore, Beggars Pizza may specify the information that franchisees must collect and maintain on their computer systems and require franchisees to provide reports from the collected data. All data pertaining to the restaurant, including customer data, is the exclusive property of Beggars Pizza, which grants the franchisee a royalty-free, nonexclusive license to use the data during the term of the agreement. Franchisees must also comply with all applicable laws regarding the privacy of consumer, employee, and transactional information and must obtain Beggars Pizza's prior written consent before publishing, disseminating, implementing, revising, or rescinding a data privacy policy.
