What is SpeedLine's sole responsibility regarding third party software purchased through them by Beggars Pizza franchisees?
Beggars_Pizza Franchise · 2025 FDDAnswer from 2025 FDD Document
Where any third party software is purchased from SpeedLine, SpeedLine's sole responsibility is to facilitate and assist in providing the Customer with the support services of the third party owner or supplier of the third party software, to which SpeedLine has access. SpeedLine will not be required to correct problems that occur after the Customer or a third party has modified, changed, adapted, abused or damaged the Software or hardware in any way, or merged the Software into or used it with any other computer program material, or translated it or re-written it into any different computer program language, or failed to use it as a single product without separation, or has made changes in computer hardware or computer operating systems after release or implementation of the Software, without the prior written permission of SpeedLine. This Agreement includes initial support for the operating system, such as implementation of patches required to run the Software on the Customer's computers, from implementation of the Software (but only where implementation is done by SpeedLine) until it is used in the Customer's business, and only if it directly relates to the operation of the Software. Computer hardware repair and services are not covered under this Agreement but would be covered by the manufacturer's hardware warranty where applicable.

What This Means (2025 FDD)
According to Beggars Pizza's 2025 Franchise Disclosure Document, when a franchisee purchases third-party software from SpeedLine, SpeedLine's only responsibility is to help the franchisee get support services from the third-party software's owner or supplier, assuming SpeedLine has access to those services. This means SpeedLine acts as a facilitator, connecting the franchisee with the appropriate support channels for the software.
SpeedLine is not obligated to fix any problems that arise if the franchisee or a third party modifies, changes, adapts, abuses, or damages the software or hardware. This also applies if the software is merged with other computer programs, translated, rewritten, or used incorrectly. Additionally, SpeedLine is not responsible for issues caused by changes in computer hardware or operating systems after the software is released or implemented, or if software updates are incompatible with the franchisee's existing systems.
Furthermore, SpeedLine is not liable for damages or losses related to third-party software purchased through them, as long as they have reasonably attempted to assist the franchisee in obtaining support services from the third-party provider. This highlights the importance for franchisees to understand the support terms and limitations of both SpeedLine and the third-party software vendors. Franchisees should ensure they have direct access to third-party support and understand the scope of that support before making any software purchase.
