What This Means (2025 FDD)
According to the 2025 Beggars Pizza FDD, SpeedLine is not responsible for incompatibilities caused by changes in computer hardware or operating systems implemented after the release or implementation of their software. This means that if a Beggars Pizza franchisee upgrades their computer hardware or operating system after the SpeedLine software is installed, SpeedLine will not be liable for any resulting issues.
This lack of responsibility extends to various scenarios. SpeedLine is not responsible if software updates are incompatible with the franchisee's existing hardware or operating system. Additionally, SpeedLine is not liable if the franchisee uses hardware or operating systems not supplied and implemented by SpeedLine or a SpeedLine-trained integrator. This highlights the importance of using SpeedLine-approved or implemented systems to maintain compatibility and support.
The FDD also clarifies that SpeedLine is not responsible for issues arising from implementations not performed by SpeedLine or a certified integrator, or if the franchisee fails to meet SpeedLine's implementation criteria. However, SpeedLine is also not responsible for issues arising from their own implementation or training, provided it was carried out properly. This suggests that Beggars Pizza franchisees should ensure that SpeedLine's software is implemented correctly and that they adhere to SpeedLine's guidelines to minimize potential problems.
Furthermore, SpeedLine disclaims all other representations, warranties, and conditions, either express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement. They do not warrant that the software's operations will be uninterrupted or error-free, nor are they responsible for the performance of the internet or any other network. This comprehensive disclaimer underscores the importance for prospective Beggars Pizza franchisees to carefully consider their technology needs and potential risks associated with software compatibility and hardware changes.
