Does PCI SSC provide any implied warranties of merchantability, fitness for purpose, or noninfringement for Beggars Pizza?

Beggars_Pizza Franchise · 2025 FDD

Answer from 2025 FDD Document

PCI SSC acceptance does not, under any circumstances, include or imply any product warranties from PCI SSC, including, without limitation, any implied warranties of merchantability, fitness for purpose or noninfringement, all of which are expressly disclaimed by PCI SSC. To the extent any rights or remedies regarding products or services that have received acceptance from PCI SSC are provided, those rights and remedies shall be provided by the party providing such products or services, and not by PCI SSC or any of its payment brand members.

What This Means (2025 FDD)

According to the 2025 FDD, the PCI Security Standards Council (PCI SSC) expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, or noninfringement. PCI SSC acceptance indicates that a product has demonstrated certain security characteristics but does not imply any endorsement or warranty by PCI SSC regarding the product vendor, the product itself, or its functionality, quality, or performance.

For a Beggars Pizza franchisee, this means that PCI SSC's acceptance of a product used in their business does not provide any guarantee of the product's suitability for their specific needs, its quality, or that it does not infringe on the rights of others. Any rights or remedies related to products or services that have received PCI SSC acceptance are provided by the party providing those products or services, not by PCI SSC.

This disclaimer is a standard practice to limit the liability of the PCI SSC. Franchisees should not rely on PCI SSC acceptance as a warranty or endorsement of any product or service. Instead, they should carefully evaluate the products and services they use and seek warranties or guarantees from the vendors themselves.
