  • 8.12 Mobile Applications.

Franchisor may establish or use, and require Franchisee to use, one or more mobile applications (a "Mobile App") for online ordering (as described in Section 7.7 above) or electronic payments, or any similar or related application for use in connection with the System.

The term "Mobile App" will include any application for use on smartphones, tablets, or other mobile devices, and may include a loyalty or reward program or other features.

If Franchisor requires Franchisee to use a Mobile App, then Franchisee must comply with Franchisor's requirements (as set forth in the Manuals or otherwise in writing) for connecting to, and utilizing, such technology in connection with Franchisee's operation of the Restaurant.

  • 8.13 Changes to Technology.

Franchisee and Franchisor acknowledge and agree that changes to technology are dynamic and not predictable within the term of the Agreement.

In order to provide for inevitable but unpredictable changes to technological needs and opportunities, Franchisor may establish reasonable new standards for the implementation of technology in the System.

Franchisee must abide by those reasonable new standards established by Franchisor as if the Agreement were periodically revised by Franchisor for that purpose.
