If a Beggars Pizza franchisee purchases third-party software from SpeedLine, what is SpeedLine's responsibility regarding support?

Beggars_Pizza Franchise · 2025 FDD

Answer from 2025 FDD Document

It does not cover computer hardware or software not purchased from SpeedLine or computer hardware which is not compatible with SpeedLine's then-current specifications nor does it cover any third party software not purchased from SpeedLine. Where any third party software is purchased from SpeedLine, SpeedLine's sole responsibility is to facilitate and assist in providing the Customer with the support services of the third party owner or supplier of the third party software, to which SpeedLine has access. SpeedLine will not be required to correct problems that occur after the Customer or a third party has modified, changed, adapted, abused or damaged the Software or hardware in any way, or merged the Software into or used it with any other computer program material, or translated it or re-written it into any different computer program language, or failed to use it as a single product without separation, or has made changes in computer hardware or computer operating systems after release or implementation of the Software, without the prior written permission of SpeedLine.

What This Means (2025 FDD)

According to Beggars Pizza's 2025 Franchise Disclosure Document, SpeedLine's responsibility regarding support for third-party software purchased from them is limited. SpeedLine's sole responsibility is to facilitate and assist in providing the Beggars Pizza franchisee with the support services offered by the third-party owner or supplier of the software, provided SpeedLine has access to those support services. This means that Beggars Pizza franchisees should not expect SpeedLine to directly troubleshoot or resolve issues with third-party software beyond connecting them with the appropriate support channels.

This arrangement places the onus on the third-party software provider for direct support. It is important for a prospective Beggars Pizza franchisee to understand that SpeedLine acts as an intermediary, and the quality and availability of support for third-party software will depend on the policies and capabilities of that third-party provider. Beggars Pizza franchisees should carefully review the support terms and conditions of any third-party software they purchase through SpeedLine to understand the level of assistance they can expect.

SpeedLine also outlines scenarios where they are not responsible for problems or incompatibilities. These include issues caused by changes to the franchisee's computer hardware or operating systems after the software's release, incompatibilities between software updates and the franchisee's existing systems, or problems arising from the franchisee using hardware or operating systems not supplied and implemented by SpeedLine or a trained integrator. Additionally, SpeedLine is not responsible for issues if the software is not implemented by SpeedLine or a trained integrator, or if the franchisee fails to meet SpeedLine's implementation criteria. These stipulations highlight the importance of adhering to SpeedLine's recommended configurations and implementation procedures to ensure proper software functionality and support eligibility for a Beggars Pizza franchisee.
