Conditioned on Customer's payment of the fees due under this Agreement and Customer's compliance with this Agreement's terms and conditions, SpeedLine grants Customer a limited, non-exclusive, non-transferable subscription license to access and use the Service for the Initial Term and any Renewal Terms(s) (as defined below).

2. SpeedLine Support

Support and updates for the Service will be provided by SpeedLine to the Customer as Standard Support or Second Level Support (as stipulated in the Quote) in accordance with SpeedLine's then current standard form of Support Services Agreement.

3. Access to Service: Customer Responsibilities

  • a. Customer is responsible for providing and maintaining a website for its business on which a link to the Service will be placed that Users will click to go to the Service and place online orders for Customer's food. Customer is responsible for all equipment, telecommunications, and services necessary to make (and maintain) its website.
  • b. SpeedLine will post the App for download by Users at app store provider websites specified in the Quote, subject to the terms and conditions of this Agreement and any rules or policies applied by the app store provider(s).
  • c. Customer understands that electronic communication is necessary for Customer's use of the Service. Customer consents to SpeedLine's receipt and storage of electronic communications, User Data and Customer Content. Customer acknowledges that Customer's electronic communications will involve transmission over the Internet and over various other networks that are not owned or operated by SpeedLine. Customer agrees that SpeedLine is not responsible for any electronic communications, User Data or Customer Content which are delayed, lost, altered, intercepted or stored without authorization during the transmission of any data whatsoever across networks not owned or operated by SpeedLine, including, without limitation, the Internet.

SpeedLine may offer optional Store Management Support Services as an add-on to either Standard Support or Second-Level Support. These services can include menu and system configuration change management, software upgrade management, password updates, and online ordering website updates. These services are detailed in SpeedLine's Store Management Support Services Agreement. SpeedLine also provides Per Incident Support for certain software licenses and services, offering telephone support during normal office hours for assistance with the function and operation of the software, charged on a per-incident basis.
