Can the Franchisor change the marketing methods used by Beggars Pizza?

WHEREAS, the distinguishing characteristics of the System include, without limitation, distinctive exterior and interior design, décor, color scheme, fixtures, and furnishings; standards and specifications for products and supplies; uniform standards, specifications, and procedures for operations; procedures for screening, recruiting and training personnel; payroll and bookkeeping procedures and policies; training and assistance; marketing methods; and advertising and promotional programs; all of which may be changed, improved and further developed by Franchisor from time to time;
Franchisor may determine acceptable and unacceptable advertising related to this Section 7.4.12, in the Manual, or otherwise in writing from time to time in its sole discretion.
Franchisor's determination will be binding.
- 7.4.13 To participate in all promotional programs developed by Franchisor for the System including, without limitation, gift card programs, gift certificate programs, loyalty programs, and coupon or discount programs (except as prohibited by applicable law), as prescribed by Franchisor in the Manual or otherwise in writing from time to time including, without limitation, selling and offering for sale gift certificates or gift cards which may be redeemed at any Beggars Pizza® restaurant for menu items or products, permitting customers who purchased gift certificates or gift cards from another Beggars Pizza® restaurant or Franchisor to redeem their gift certificates for menu items or products at the Restaurant, participating in Franchisor's customer complaint program which may require Franchisee to offer free gift certificates at Franchisee's expense to customers complaining about service at the Restaurant, and installing and using the required equipment or information systems necessary to allow customers to participate in System loyalty programs at Franchisee's expense.
Franchisee must comply with all of Franchisor's policies regarding advertising and promotion including, without limitation, the use and acceptance of coupons and gift cards.
- 7.4.14 To participate in all online, electronic, or centralized ordering programs developed or designated by Franchisor for the System, and only such online, electronic, or centralized ordering programs developed or designated by Franchisor, as prescribed by Franchisor in the Manual or otherwise in writing from time to time.
Such participation may include, without limitation, installing and using, at Franchisee's expense, the required fixtures, equipment, and information systems necessary for participation, and paying to Franchisor and/or a designated third- party provider the then-current fees associated with such programs.

What This Means (2025 FDD)
According to Beggars Pizza's 2025 Franchise Disclosure Document, the franchise agreement grants Beggars Pizza the authority to modify marketing methods. The agreement states that the characteristics of the Beggars Pizza system include marketing methods and advertising and promotional programs, all of which may be changed, improved and further developed by Beggars Pizza from time to time.
Beggars Pizza also has the right to determine what advertising is acceptable and unacceptable. The determination made by Beggars Pizza will be binding. As such, Beggars Pizza franchisees must participate in all promotional programs developed by Beggars Pizza for the system, including gift card, loyalty, and coupon programs. Franchisees must also comply with all of Beggars Pizza's policies regarding advertising and promotion, including the use and acceptance of coupons and gift cards.
Furthermore, Beggars Pizza franchisees must participate in any online, electronic, or centralized ordering programs that Beggars Pizza develops or designates for the system. This participation may require the franchisee to install and use required fixtures, equipment, and information systems at their own expense, as well as pay fees to Beggars Pizza or a third-party provider.
