- 8.2 Franchisee's Use of the Proprietary Marks. With respect to Franchisee's use of the Proprietary Marks:
- 8.2.1 Franchisee must use only the Proprietary Marks designated by Franchisor, and must use them only in the manner authorized and permitted by Franchisor;
- 8.2.2 Franchisee must use the Proprietary Marks only for the operation of the Restaurant and only at the Approved Location, or in advertising for the Restaurant conducted at or from the Approved Location;
- 8.2.3 Unless otherwise authorized or required by Franchisor, Franchisee must operate and advertise the Restaurant only under the name "Beggars Pizza®" and must use all Proprietary Marks without prefix or suffix. Franchisee will not use the Proprietary Marks as part of its corporate or other legal name;
- 8.2.4 During the term of the Agreement, Franchisee must identify itself as the owner of the Restaurant in the manner required by Franchisor in conjunction with any use of the Proprietary Marks including, without limitation, on invoices, order forms, receipts, business stationery, and contracts with all third parties or entities. Franchisee must display notices to that effect in such content and form at such conspicuous locations as Franchisor designates in writing;
- 8.2.5 Franchisee's right to use the Proprietary Marks is limited to such uses as are authorized under the Agreement, and any unauthorized use thereof will constitute an infringement

What This Means (2025 FDD)
According to Beggars Pizza's 2025 Franchise Disclosure Document, a franchisee is permitted to use the Proprietary Marks for the operation of their restaurant and in advertising for the restaurant. However, this use is specifically limited to the Approved Location. The franchisee must use only the Proprietary Marks designated by Beggars Pizza and only in the manner authorized and permitted by them.
Beggars Pizza requires that the franchisee operate and advertise the restaurant only under the name "Beggars Pizza®" unless otherwise authorized or required by the company. The franchisee cannot use the Proprietary Marks as part of their corporate or legal name. The franchisee must also identify themselves as the owner of the restaurant in conjunction with any use of the Proprietary Marks, including on invoices, order forms, receipts, business stationery, and contracts with third parties.
The right to use the Proprietary Marks is limited to the uses authorized under the Franchise Agreement. Any unauthorized use of the marks constitutes an infringement of the Trademark Owner's rights, which entitles Beggars Pizza to exercise its rights under the agreement, as well as all rights available at law or in equity. Upon termination or expiration of the Franchise Agreement, the franchisee must immediately and permanently cease all use of the Proprietary Marks.
