Beggars_Pizza Franchise · 2025 FDD

Answer from 2025 FDD Document

16. OBLIGATIONS UPON TERMINATION OR EXPIRATION

Upon termination or expiration of the Agreement, all rights granted hereunder to Franchisee will forthwith terminate, and:

  • 16.4 Assignment of Lease. Franchisee must, at Franchisor's option, assign to Franchisor any interest which Franchisee has in any lease or sublease for the Premises. If Franchisor does not elect to exercise its option to acquire the lease or sublease for the Premises, Franchisee must make such modifications or alterations to the premises immediately upon termination or expiration of the Agreement as may be necessary to distinguish the appearance of the premises from that of the Restaurant under the System, and must make such specific additional changes thereto as Franchisor may reasonably request for that purpose.

What This Means (2025 FDD)

Based on the 2025 Beggars Pizza Franchise Disclosure Document, the document does not specify what evidence a franchisee must provide to demonstrate their right to remain in possession of the premises for the renewal term. However, the FDD does state that upon the termination or expiration of the franchise agreement, Beggars Pizza has the option to request the franchisee to assign any interest in the lease or sublease for the premises to Beggars Pizza. If Beggars Pizza does not exercise this option, the franchisee is obligated to modify the premises to differentiate its appearance from a Beggars Pizza restaurant.

It is important to note that the franchise agreement renewal addendum states that the franchisee will operate the restaurant only at the location identified in Exhibit A, also known as the "Approved Location." The addendum also states that the franchisee will not relocate the restaurant without prior written approval from Beggars Pizza, which Beggars Pizza may withhold at its sole discretion.

To fully understand the requirements for demonstrating the right to remain in possession of the premises for a renewal term, a prospective Beggars Pizza franchisee should seek clarification from the franchisor regarding the specific documentation or proof required to ensure continued occupancy of the location. This information is crucial for franchisees to plan for the future and protect their investment in the business.
