What This Means (2025 FDD)

According to Beehive Homes' 2025 Franchise Disclosure Document, the "Names and Marks" encompass the trade name, trademark, or service mark "BEE HIVE HOMES®", the Trade Name, and other similar names, service marks, trademarks, trade names, and copyrights. These also include all ancillary signs, symbols, slogans, phrases, emblems, designs, and other indicators designated by Beehive Homes and used in connection with the Home and the System.

For a prospective franchisee, this means that when operating a Beehive Homes franchise, they are authorized to use the specified "Names and Marks" exclusively for the purpose of operating the Home under the terms of the franchise agreement. The franchisee is required to display their Trade Name, which is "BEE HIVE HOMES of [Location]", on all signs, stationery, business cards, advertising materials, and other media, strictly following the guidelines in the Manual.

The franchisee must also file and keep current a "fictitious name certificate" for the Trade Name in the relevant county and/or state. Importantly, the franchisee cannot use any of the "Names and Marks," the name "BEE HIVE HOMES®," or any form of it in connection with any corporate, partnership, or other entity name, any internet-related name (including a domain name), or any other business without prior written approval from Beehive Homes. Upon termination of the franchise agreement, the franchisee must immediately stop using the Trade Name and the "Names and Marks".

This definition is important because it protects Beehive Homes' brand identity and goodwill, while also setting clear boundaries for how franchisees can represent their business. Franchisees must adhere to these guidelines to maintain uniformity and quality across all Beehive Homes locations and to avoid any potential legal issues related to trademark infringement or unauthorized use of the brand's intellectual property.
