What This Means (2025 FDD)
According to the 2025 Beehive Homes Franchise Disclosure Document, as a Guarantor, your signature on the Guaranty and Assumption of Obligations Under Franchise Agreement is effective as of the date of execution of the Franchise Agreement. This means that your obligations as a guarantor become legally binding on the same date that the franchisee signs the franchise agreement with Beehive Homes.
The Guaranty ensures that the guarantor is responsible for the franchisee's financial and performance obligations to Beehive Homes. This includes the full and prompt payment of all sums owed by the franchisee, such as fees, charges, interest, and attorney's fees, as well as the performance of all other obligations outlined in the Franchise Agreement.
Beehive Homes requires the guarantor to acknowledge and agree to several terms, including that the validity of the guaranty will not be affected by any waivers or failure to enforce terms by Beehive Homes, and that the guaranty represents the entire agreement between the franchisor and guarantor. This underscores the importance of carefully reviewing the Guaranty and understanding the full extent of the obligations being undertaken.
Prospective Beehive Homes franchisees should ensure that all guarantors fully understand their responsibilities and have the opportunity to seek legal counsel before signing the Guaranty. This will help avoid potential disputes or misunderstandings in the future.
