What is the Beehive Homes franchisee's obligation regarding state-specific portions of the Manual?

According to Beehive Homes' 2025 Franchise Disclosure Document, franchisees must comply with the standards outlined in the Manual. The Manual contains the standards, specifications, requirements, criteria, and policies developed by Beehive Homes for franchisees to use in connection with the design, construction, renovation, appearance, equipping, furnishing, supplying, opening, operating, maintaining, marketing, services, service levels, quality, and quality assurance of Homes. The Manual may consist of one or more of the following; Policies and Procedures, Owner/Operator Training, Emergency Procedures, Inservice Training and/or Employee Procedures. The Manual may take various forms, including looseleaf or bound volumes, bulletins, notices, videos, CD-ROMS, electronic media, websites, online postings, e-mail, electronic communications, or facsimiles.

Specifically, the FDD states that portions of the Manual may be state-specific. It is the franchisee's responsibility to identify these state-specific sections and ensure they remain current and up-to-date. This implies that franchisees need to be aware of the regulations and requirements specific to their state and proactively update their practices and procedures to align with any changes in those regulations.

Furthermore, the Beehive Homes franchisee is prohibited from disclosing the contents of the Manual to any unauthorized person. Upon termination of the Franchise Agreement, the franchisee must return all forms of the Manual to Beehive Homes. This underscores the confidential nature of the Manual and the importance of safeguarding its contents, as it contains proprietary information critical to the operation of a Beehive Homes franchise.
