- (e) Nonexclusive. Franchisee understands and agrees that its license to use the Names and Marks, Trade Secrets and Copyrighted Materials is nonexclusive and that Franchisor, in its sole discretion, has the right, itself to operate Homes and provide services under said Names and Marks and to grant other licenses to use the Names and Marks on any terms and conditions the Franchisor deem appropriate.

What This Means (2025 FDD)
According to Beehive Homes' 2025 Franchise Disclosure Document, the franchisee's license to use the Names and Marks is nonexclusive. Beehive Homes retains the right to operate its own homes and grant licenses to others under the same Names and Marks, under terms and conditions it deems appropriate. This means a franchisee may find themselves operating in the same area as a company-owned Beehive Homes location or another franchisee.
Beehive Homes maintains ownership of any goodwill associated with the Names and Marks, Trade Secrets, Copyrighted Materials, and the System, including any goodwill that arises from a franchisee's activities. The franchisee is obligated to protect and preserve the goodwill of the Names and Marks and must operate their home and provide services in strict accordance with the System, the franchise agreement, the manual, and other operational standards established by Beehive Homes.
Beehive Homes also has the right to modify or discontinue the use of any Names and Marks, or to add or substitute them. In such cases, Beehive Homes will reimburse the franchisee for the actual costs of changing signs and replacing printed materials to comply with the changes. This protects Beehive Homes's brand identity while potentially creating an expense for the franchisee if rebranding is required.
Franchisees are restricted in their use of websites and domain names related to Beehive Homes. They cannot register, own, or maintain any sites that relate to the Home or include any of the Names and Marks without written approval from Beehive Homes. This control ensures brand consistency and protects Beehive Homes's online presence.
