- (e) Nonexclusive. Franchisee understands and agrees that its license to use the Names and Marks, Trade Secrets and Copyrighted Materials is nonexclusive and that Franchisor, in its sole discretion, has the right, itself to operate Homes and provide services under said Names and Marks and to grant other licenses to use the Names and Marks on any terms and conditions the Franchisor deem appropriate.
- (f) Confidential Treatment. Franchisee acknowledges that the Trade Secrets are proprietary and confidential and agrees that it shall protect, preserve and not disclose the Trade Secrets to anyother person, including employees, agents, successors or assigns, except as may be specifically allowed under this Agreement.

According to the 2025 Beehive Homes Franchise Disclosure Document, franchisees are granted a nonexclusive license to use the brand's Names and Marks. Specifically, Beehive Homes retains the right to operate its own homes and to grant licenses to others under the same Names and Marks, at its discretion. This means that a franchisee's right to use the Beehive Homes branding is not exclusive to their territory or operation. The franchisee acknowledges that all goodwill associated with the Names and Marks inures solely to the benefit of Beehive Homes.
Beehive Homes franchisees must use the appropriate symbols (TM, SM, or R) with the Names and Marks and cannot use their own name in conjunction with the Beehive Homes branding without prior written consent. Franchisees are required to operate under the trade name "BEE HIVE HOMES of [Location]" and must obtain a fictitious name certificate for this trade name. They are also prohibited from using the Beehive Homes name in any corporate filings, internet domain names, or other businesses without explicit approval from Beehive Homes.
Beehive Homes maintains the right to modify or discontinue the use of any Names and Marks, and franchisees must comply with these changes. In such cases, Beehive Homes will reimburse the franchisee for the actual costs of changing signs and replacing printed materials. Upon termination of the franchise agreement, franchisees must immediately cease using the Trade Name and Names and Marks, and return or destroy all related materials at Beehive Homes's discretion.
This non-exclusive arrangement is a standard practice in franchising, allowing Beehive Homes to expand its brand presence without being restricted by individual franchise territories.
