Does the Beehive Homes definition of 'Names and Marks' include the trade name?

According to Beehive Homes' 2025 Franchise Disclosure Document, the definition of "Names and Marks" does include the trade name. Specifically, it encompasses the trade name, trademark, or service mark "BEE HIVE HOMES®", the Trade Name, and other similar names, service marks, trademarks, trade names and copyrights. This also extends to all ancillary signs, symbols, slogans, phrases, emblems, designs, and other indicia indicated by Beehive Homes and used in connection with the Home and the System.

This means that as a franchisee, you are granted the right to use these "Names and Marks" including the trade name, but only for the purpose of operating your Beehive Homes franchise. You must adhere to the standards and guidelines set forth by Beehive Homes regarding the use of these names and marks. Any unauthorized use or modification could be a breach of the franchise agreement.

Beehive Homes retains ownership of all trademarks, service marks, trade names (including the Trade Name), and copyrights, along with any related elements developed for the franchise. Franchisees can only use these during the term of the agreement and as specified within the agreement. Upon termination or expiration of the agreement, the franchisee must immediately cease using the Names and Marks and return or destroy all related materials as directed by Beehive Homes. This ensures that Beehive Homes maintains control over its brand identity and goodwill.
