What This Means (2025 FDD)
According to the 2025 Beef O Bradys FDD, a franchisee looking to transfer their Family Sports Pub must meet certain conditions before the transfer can be approved. One of these conditions involves submitting all required reports and statements. Specifically, the franchisee must have submitted all reports and statements that are required.
In addition to submitting all required reports and statements, the franchisee must have paid all royalties, marketing contributions, amounts owed for purchases from Beef O Bradys, and all other amounts owed to Beef O Bradys or to third-party creditors. The proposed transferee must also be of good character and meet the then-applicable standards for Family Sports Pub franchisees.
Furthermore, if Beef O Bradys does not exercise its option to purchase the Family Sports Pub, the franchisee must provide a signed and notarized statement attesting to the quantity (dollar amount) of unredeemed gift certificates outstanding and a method for reimbursement to franchise members of the Beef O Brady's System for a period of one year from the date of store closing. Reimbursement must be guaranteed by funds held in escrow or affidavit. The franchisee must also furnish Beef O Bradys with evidence satisfactory to them of compliance with the obligations within 30 days after the effective date of expiration of the Franchise Agreement or the Notification Date.
