Who pays for the training of the manager appointed after the death or disability of a Beef O Bradys franchisee?

- 15.6 Operation Upon Death or Disability. If, upon your death or disability or the death or disability of the owner of a controlling interest in you, the Family Sports Pub is not being managed by a trained manager, your or such Owner's executor, administrator, conservator, guardian or other personal representative must within a reasonable time, not to exceed 15 days from the date of death or disability, appoint a manager to operate the Family Sports Pub.
Such manager will be required to complete training at your expense.
Pending the appointment of a manager as provided above or if, in our judgment, the Family Sports Pub is not being managed properly any time after your death or disability or after the death or disability of the owner of a controlling interest in you, we have the right, but not the obligation, to appoint a manager for the Family Sports Pub.
All funds from the operation of the Family Sports Pub during the management by our appointed manager will be kept in a separate account, and all expenses of the Family Sports Pub, including wages, other costs and travel and living expenses of our manager, will be charged to this account.
We also have the right to charge a reasonable management fee (in addition to the Royalty and Marketing Contributions payable under this Agreement) during the period that our appointed manager manages the Family Sports Pub.

What This Means (2025 FDD)
According to Beef O Bradys's 2025 Franchise Disclosure Document, if a franchisee or the owner of a controlling interest in the franchise dies or becomes disabled, and the Family Sports Pub is not being managed by a trained manager, the executor, administrator, conservator, guardian, or other personal representative must appoint a manager within 15 days to operate the Family Sports Pub. The cost of training this appointed manager is the responsibility of the franchisee's estate or the owner's representative.
If the franchisee fails to appoint a manager or if Beef O Bradys believes the Family Sports Pub is not being managed properly, Beef O Bradys has the right, but not the obligation, to appoint a manager. In this case, all funds from the operation of the Family Sports Pub will be kept in a separate account. All expenses of the Family Sports Pub, including wages, other costs, and travel and living expenses of the Beef O Bradys-appointed manager, will be charged to this account.
Additionally, Beef O Bradys has the right to charge a reasonable management fee, in addition to the Royalty and Marketing Contributions already outlined in the Franchise Agreement, during the period that their appointed manager manages the Family Sports Pub. This ensures that the business continues to operate according to Beef O Bradys's standards, although the financial burden for the manager's training falls on the franchisee's estate.
