What This Means (2025 FDD)
According to the 2025 Beef O Bradys Franchise Disclosure Document, franchisees must comply with anti-terrorism laws. Beef O Bradys requires franchisees to comply with Executive Order 13224 issued by the President of the United States, the USA PATRIOT Act, and all other present and future federal, state and local laws, ordinances, regulations, policies, lists and any other requirements of any governmental authority addressing or in any way relating to terrorist acts and acts of war, which are defined as the "Anti-Terrorism Laws".
As part of this compliance, franchisees must certify, represent, and warrant that none of their property or interests are subject to being "blocked" under any of the Anti-Terrorism Laws and that they are not otherwise in violation of any of the Anti-Terrorism Laws. This means a franchisee must ensure that their assets and operations do not run afoul of any regulations aimed at preventing terrorism financing or activities.
Any violation of the Anti-Terrorism Laws by a Beef O Bradys franchisee or their employees, or any "blocking" of their assets under these laws, constitutes grounds for immediate termination of the Franchise Agreement and any other agreements with Beef O Bradys or its affiliates. This clause underscores the seriousness with which Beef O Bradys views compliance with anti-terrorism measures, placing the onus on the franchisee to maintain scrupulous adherence to all applicable laws and regulations.
This requirement is not uncommon in franchising, particularly for businesses with a national presence, as franchisors seek to protect their brand and ensure compliance with federal regulations. Prospective Beef O Bradys franchisees should carefully review these requirements and ensure they have the resources and understanding necessary to comply with all applicable Anti-Terrorism Laws.
