What This Means (2025 FDD)
Based on the 2025 Beef O Bradys Franchise Disclosure Document, the document does not specify the franchisee's obligation if their copy of the Manuals is significantly damaged. The FDD does define the Manuals as materials that Beef O Bradys generally grants access to franchisees for use in operating a Family Sports Pub.
However, the FDD does outline the franchisee's responsibilities regarding proprietary manuals upon termination or if Beef O Bradys does not exercise its option to purchase the Family Sports Pub. In such cases, the franchisee must return all proprietary manuals, including operations manuals, recipe playbooks, food service charts, prep sheets, HACCP materials, marketing workbooks and guides, marketing materials, and discount cards. These items must be returned via ground delivery service no later than the day of closing, with a copy of the shipping order provided to Beef O Bradys.
Since the FDD does not explicitly address the scenario where the manuals are damaged during the franchise term, it is important for a prospective franchisee to clarify with Beef O Bradys what the procedure is for replacing or obtaining new copies of the manuals if they become damaged or unusable. This inquiry should cover any associated costs or fees for replacement manuals.
