What This Means (2025 FDD)
According to Beef O Bradys's 2025 Franchise Disclosure Document, if Beef O Bradys does not exercise its option to purchase the Family Sports Pub, the franchisee must return all proprietary manuals to Beef O Bradys. These manuals include operations manuals, recipe playbooks, food service charts, prep sheets, HACCP materials, marketing workbooks and guides, marketing materials, and discount cards.
The franchisee is responsible for shipping these items via ground delivery service no later than the day of closing. Additionally, the franchisee must provide Beef O Bradys with a copy of the bill of lading or shipping order as proof of shipment.
This requirement ensures that upon termination or expiration of the franchise agreement, Beef O Bradys retains control over its confidential and proprietary information. This is a standard practice in franchising to protect the brand's operational methods and marketing strategies. Franchisees should factor in the cost and logistics of returning these materials when considering the termination or non-renewal of their franchise agreement.
