What This Means (2025 FDD)
According to the 2025 Beef O Bradys Franchise Disclosure Document, franchisees are restricted in providing their employees with access to the Confidential Operating Manual. While Beef O Bradys loans a copy of the manual to the franchisee during the franchise term, it remains the proprietary property of Beef O Bradys and must be returned upon termination of the Franchise Agreement or at their request.
The FDD specifies that franchisees must use their best efforts to keep the information in the Confidential Operating Manual confidential. Employees can only access the manual as necessary to operate the Family Sports Pub. This implies that access should be limited to only those parts of the manual relevant to an employee's specific job duties and that franchisees must take precautions to prevent unauthorized disclosure of the manual's contents.
This policy is typical in franchising, as the operating manual contains trade secrets and other confidential information vital to the brand's success. Unauthorized access or disclosure could harm Beef O Bradys' competitive advantage. Franchisees are also responsible for keeping their copy of the Confidential Operating Manual up-to-date and must comply with any supplements or amendments provided by Beef O Bradys. Franchisees cannot photocopy any part of the Confidential Operating Manual without written consent from Beef O Bradys.
