What This Means (2025 FDD)
According to Beef O Bradys's 2025 Franchise Disclosure Document, upon termination or expiration of the Franchise Agreement, if Beef O Bradys does not exercise its option to purchase the Family Sports Pub, the franchisee is obligated to return all proprietary manuals. These include operations manuals, recipe playbooks, food service charts, prep sheets, HACCP materials, marketing workbooks and guides, marketing materials, and discount cards.
These items must be returned via ground delivery service no later than the day of closing. The franchisee must also provide Beef O Bradys with a copy of the bill of lading or shipping order as proof of return. This ensures that Beef O Bradys retains control over its confidential and proprietary information, preventing it from being used to compete against the franchise system after the agreement ends.
This requirement is standard practice in franchising to protect the franchisor's intellectual property and maintain uniformity across the franchise system. By mandating the return of these manuals, Beef O Bradys aims to prevent former franchisees from utilizing its operational knowledge and marketing strategies outside the franchise network, which could potentially harm the brand's reputation and competitive advantage.
