What This Means (2025 FDD)

According to Beef O Bradys' 2025 Franchise Disclosure Document, upon termination or expiration of the franchise agreement, franchisees must remove specific food presentation items to distinguish the restaurant from its former appearance and prevent public confusion. This includes removing all green plastic baskets, green checkered paper, current salad bowls, cups, plates, logo napkins, and coasters. These items are considered part of the Beef O Bradys system's trade dress and brand identity.

This requirement ensures that customers will not confuse the terminated franchise with an active Beef O Bradys location. It also protects Beef O Bradys' brand and reputation by preventing a former franchisee from operating a similar restaurant that could be mistaken for a Beef O Bradys.

Franchisees are responsible for the expense of removing these items. Failing to remove these items could result in legal action from Beef O Bradys to enforce the terms of the franchise agreement. This is a standard practice in franchising to maintain brand consistency and prevent consumer confusion when a franchise agreement ends.
