45 days (or during the time period agreed upon in the Area Development Agreement) of the Site Selection Period, you must obtain our approval of the Site Selection Area(s). The "Site Selection Area(s)" will, following our approval, consist of one or more trade areas or intersections of streets within which you are interested in locating your Site. When the Site Selection Area(s) are determined, we will complete Exhibit A and provide a copy of it to you.

  • (b) Site Identification: If not already approved on the date of signing the Agreement, you must obtain our prior written approval of a Site you propose within the Site Selection Area(s). Prior to the 90th day following the Effective Date, you must identify your proposed Site (which must be located within the Site Selection Area(s)) and submit it to us for our approval.

What This Means (2025 FDD)

According to the 2025 Beef O Bradys FDD, a franchisee must identify a proposed site and submit it for approval prior to the 90th day following the effective date of the Franchise Agreement. The site must be located within the designated Site Selection Area.

If Beef O Bradys rejects the initial proposed site, the franchisee has an additional 30 days from the date of rejection (but before the Site Selection Period expires) to identify and submit an alternative site for approval. Beef O Bradys is not obligated to consider any sites submitted after the Site Selection Period or outside the Site Selection Area.

Beef O Bradys' approval of a site indicates only that the site meets the company's criteria at the time of approval. If a site is not approved within the specified deadlines, Beef O Bradys is not obligated to allow the franchisee to submit another proposed site.
