What constitutes the Protected Territory for a Beef O Bradys franchise?

According to Beef O Bradys's 2025 Franchise Disclosure Document, the Protected Territory granted to a franchisee is defined as the geographic area within a 3-mile radius of the front door of the Restaurant location.

This means that, provided the franchisee remains in compliance with the Franchise Agreement, Beef O Bradys will not grant another franchise to operate a Family Sports Pub within that 3-mile radius. This gives the franchisee a degree of exclusivity in their immediate market area, intending to allow them to establish and grow their business without direct competition from another Beef O Bradys location.

However, the FDD also stipulates several important exceptions to this protected territory. Beef O Bradys retains the right to establish Family Sports Pubs anywhere outside the Protected Territory, even immediately proximate to its border. They can also operate or franchise businesses that don't use the Beef O Bradys Marks, and market through alternative channels of distribution like the internet or retail stores, even within the Protected Territory. Furthermore, Beef O Bradys can merge with or acquire other businesses, regardless of their location, and operate them under different names, even if they are within or near the franchisee's Protected Territory.

These exceptions mean that while a franchisee has some local protection from direct Beef O Bradys competition, the franchisor retains considerable freedom to operate or license other businesses that may compete in the same general market. A prospective franchisee should carefully consider these limitations and how they might affect the potential success of their Beef O Bradys location.
