What This Means (2025 FDD)

According to the 2025 Beef O Bradys FDD, the Confidentiality, Non-Solicitation, and Non-Competition Agreement is signed by the franchisee and, if the franchisee is a business entity, by any of their Owners, who are then classified as Restricted Persons. This agreement is designed to protect Beef O Bradys' confidential information and maintain a free exchange of ideas among Family Sports Pubs.

This agreement restricts the franchisee and their Owners from engaging in or having an interest in any Competitive Business, which includes bars, sports pubs, restaurants, or food service facilities that offer similar menu items, products, or services as Beef O Bradys. The restrictions apply during the term of the Franchise Agreement, preventing franchisees from operating or being involved with competing businesses, except under a franchise agreement with Beef O Bradys.

Furthermore, the agreement prohibits the recruitment of employees from Beef O Bradys Family Sports Pubs. These measures ensure that franchisees remain committed to the Beef O Bradys system and do not use confidential information or resources to benefit competing businesses. This is a common practice in franchising to protect the brand and maintain a competitive advantage.
