Does Bee Organized have the right to copyright advertising materials and design specifications?

"Copyrights" means all works and materials for which we or any affiliate of ours has secured common law or registered copyright protection and we utilize and/or allow Bee Organized Business franchisees to use, sell or display in connection with the development, marketing and/or operation of a Bee Organized Business, whether as of the Effective Date or any time in the future.
"Intellectual Property" means, individually and collectively, our Licensed Marks, Copyrights, Know-How, and System.
Generally All advertising, marketing, marketing materials and all marketing mediums used by you in the marketing and promotion of the Franchised Business must be pre-approved by us in writing and conform to our standards and specifications. You may only use those advertising and marketing materials and mediums that we designate and approve in writing. In our discretion we may make available to you approved marketing templates comprised of pre-approved ads, ad copy and digital media that you may utilize at your own expense. If you wish to utilize marketing materials and/or marketing mediums that are not currently approved by us in writing, you may submit a written request requesting permission and we will approve or disapprove of your request within 15 days of your submission of the written request and sample marketing materials. We are not required to conduct any advertising or spend any amount on your behalf on advertising in your operating territory. (Franchise Agreement, Article 9);
All digital media and marketing must be approved by us. We will designate for your Operating Territory information about your Bee Organized Business on the www.beeorganized.com/franchiseopportunities webpage or such other websites as we may designate for the System. What This Means (2025 FDD)
According to Bee Organized's 2025 Franchise Disclosure Document, Bee Organized retains the rights to materials for which they have secured copyright protection. The FDD defines "Copyrights" as all works and materials for which Bee Organized or its affiliates have secured common law or registered copyright protection. These copyrighted materials are those that Bee Organized utilizes and/or allows its franchisees to use, sell, or display in connection with the development, marketing, and/or operation of a Bee Organized Business, whether as of the effective date of the agreement or any time in the future.
Bee Organized requires franchisees to use marketing materials that the company pre-approves. Franchisees must get written approval and adhere to Bee Organized's standards and specifications for all advertising, marketing materials, and mediums used to promote the franchise. Bee Organized may provide approved marketing templates with pre-approved ads, ad copy, and digital media for franchisees to use at their own expense. If a franchisee wants to use materials not already approved, they must submit a written request, and Bee Organized will approve or disapprove it within 15 days.
Bee Organized also maintains control over digital media and website content. All digital media and marketing efforts require the company's approval. Bee Organized designates information about each franchise location on the www.beeorganized.com/franchiseopportunities webpage or other designated websites. This ensures brand consistency and allows Bee Organized to manage its online presence and marketing strategies effectively.
