What This Means (2025 FDD)
According to Bee Organized's 2025 Franchise Disclosure Document, upon termination of the franchise agreement, a franchisee is generally required to return all confidential materials, equipment, software, information, and property owned by Bee Organized. This includes the Operations Manual, all parts, supplements, and copies of the Operations Manual, the Confidential Information (including the Business Management System Data and all client lists and information). The franchisee must also cease using any digital media, intra-nets, cloud-based systems, and/or servers that store the Operations Manual or Confidential Information.
However, the franchisee is permitted to retain specific documents after the termination of the Bee Organized franchise agreement. These include the franchisee's copies of the Franchise Agreement itself and correspondence between Bee Organized and the franchisee. It is important to note that any Confidential Information contained within or attached to this correspondence must still be returned.
Additionally, the franchisee can retain other documents that they need to keep to comply with applicable laws. This provision acknowledges that franchisees may have legal obligations to retain certain records for tax, employment, or other regulatory purposes. It is the franchisee's responsibility to identify and retain those documents as required by law, while still adhering to the obligation to return all confidential information and materials belonging to Bee Organized.
