What This Means (2025 FDD)

According to Beauty Bungalows' 2025 Franchise Disclosure Document, Beauty Bungalows Franchising, LLC has the right to enter the franchisee's premises under specific circumstances. These include the need to make modifications or alterations to protect the Beauty Bungalows system and marks, to address any defaults under the Franchise Agreement or the lease agreement, or to remove distinctive elements of the Beauty Bungalows trade dress upon the expiration or termination of the Franchise Agreement. This right is granted without Beauty Bungalows being considered guilty of trespass or any other crime or tort.

This provision means that Beauty Bungalows retains significant control over the physical appearance and operation of the franchise location. It ensures that the franchisee adheres to the brand's standards and maintains the integrity of the Beauty Bungalows system. The franchisee should be aware that Beauty Bungalows is not responsible for any damages the franchisee might incur as a result of actions taken during these entries, although Beauty Bungalows will cover the cost of repairing damage to the premises resulting from the removal of trade dress items.

For a prospective franchisee, this clause highlights the importance of understanding and complying with Beauty Bungalows' standards and requirements. It also underscores the potential for Beauty Bungalows to intervene directly in the operation of the franchise if necessary to protect its brand and system. Franchisees should maintain open communication with Beauty Bungalows to avoid situations that could lead to such interventions. This clause is fairly standard in franchise agreements, as franchisors typically need the ability to enforce brand standards and protect their trademarks.
