What This Means (2025 FDD)

According to Beauty Bungalows' 2025 Franchise Disclosure Document, the rights and remedies available to both parties are cumulative and not alternative. This means that Beauty Bungalows has multiple options available to them if the franchisee breaches the agreement, and exercising one remedy does not prevent them from pursuing others.

This provision is highly favorable to Beauty Bungalows, as it provides them with maximum flexibility in addressing any defaults by the franchisee. For a prospective franchisee, this means that a breach of the agreement could lead to a combination of penalties and legal actions, increasing the potential consequences of non-compliance.

For example, if a Beauty Bungalows franchisee fails to meet certain performance standards, Beauty Bungalows could terminate the agreement, pursue legal action for damages, and retain any fees already paid. This cumulative approach to remedies ensures that Beauty Bungalows can fully protect its interests and the integrity of its brand. Franchisees should be aware of this provision and understand the importance of adhering to all terms and conditions of the franchise agreement to avoid triggering multiple remedies.
