What This Means (2025 FDD)

According to Beauty Bungalows' 2025 Franchise Disclosure Document, a franchisee has the right to solicit potential customers within their designated Protected Territory. However, there are specific limitations to this right. A Beauty Bungalows franchisee cannot knowingly or directly solicit or attempt to entice customers of another Beauty Bungalows franchisee. This restriction aims to prevent franchisees from actively poaching customers from each other's established bases.

Despite the restriction on directly soliciting other franchisees' customers, Beauty Bungalows franchisees are permitted to engage in general solicitation of potential customers through direct mail and social media advertising. This is allowed as long as the advertising is intended as a general solicitation across large, multiple geographic areas and not specifically targeted at the customer base of another franchisee. This provision enables franchisees to broadly market their services without violating the restrictions on targeted solicitation.

It's important to note that Beauty Bungalows retains certain rights regarding marketing and customer solicitation. The franchisor can implement Multi-Area Marketing Programs, which may involve the franchisor or others soliciting or selling to customers or potential customers anywhere. However, in such programs, franchisees have the option to service any customer within their Protected Territory who is acquired through these multi-area marketing efforts. This ensures that franchisees have the opportunity to benefit from customers within their territory, even if those customers were initially reached through the franchisor's broader marketing initiatives.
