Beauty_Bungalows Franchise · 2025 FDD

Answer from 2025 FDD Document

All employees you hire or employ at your Beauty Bungalows Franchise will be your employees and your employees alone, and will not, for any purpose, be deemed to be our employees or subject to our direct or indirect control, most particularly with respect to any mandated or other insurance coverage, taxes or contributions, or requirements regarding withholdings, levied or fixed by any governmental authority. You will file your own tax, regulatory and payroll reports, and be responsible for all employee benefits and workers compensation insurance payments for your employees and operations. We will not have the power to hire or fire your employees. Our authority under the Franchise Agreement to train and approve your supervisorial or managerial personnel for qualification to perform certain functions at your Beauty Bungalows Franchise does not directly or indirectly vest us with the power to hire, fire or control any of your personnel. You and you alone will be solely responsible for all hiring and employment decisions and functions relating to the Beauty Bungalows Franchise, including those related to hiring, firing, training, establishing remuneration, compliance with wage and hour requirements, personnel policies, benefits, recordkeeping, supervision and discipline of employees, regardless of whether you have received advice from us on these subjects or not. Any guidance we may give you regarding employment policies should be considered merely examples. You will be responsible for establishing and implementing your own employment policies, and should do so in consultation with local legal counsel experienced in employment law.

What This Means (2025 FDD)

According to Beauty Bungalows' 2025 Franchise Disclosure Document, the franchisee is solely responsible for establishing and implementing their own employment policies. This means that as a Beauty Bungalows franchisee, you have the autonomy to create and enforce the policies that govern your employees, including hiring, firing, training, setting wages, and ensuring compliance with labor laws. While Beauty Bungalows may offer guidance on employment policies, these are merely examples, and the franchisee should consult with local legal counsel experienced in employment law to ensure compliance.

This responsibility extends to all aspects of employment, including compliance with wage and hour requirements, personnel policies, benefits, recordkeeping, supervision, and discipline of employees. The FDD emphasizes that employees hired for the Beauty Bungalows franchise are solely the franchisee's employees and are not subject to direct or indirect control by Beauty Bungalows Franchising, LLC. This distinction is particularly important regarding insurance coverage, taxes, contributions, and withholdings required by governmental authorities.

Beauty Bungalows Franchising, LLC does not have the power to hire or fire the franchisee's employees. Their authority is limited to training and approving supervisorial or managerial personnel for specific functions within the Beauty Bungalows franchise. This ensures that while Beauty Bungalows maintains brand standards through training of managerial staff, the franchisee retains control over employment decisions and policies.

As a prospective franchisee, it is crucial to understand that you will bear the full responsibility for all employment-related matters. This includes staying up-to-date with local and federal employment laws and regulations, creating comprehensive employee handbooks, and managing any employee disputes or legal issues that may arise. Consulting with legal counsel is highly recommended to navigate these responsibilities effectively.
