If I enter into an ADA with Beauty Bungalows, what document am I required to sign?

If you enter into a ADA with us, then upon execution of the ADA, we will designate an exclusive Development Area within which you will develop and establish franchised locations. You must execute our then-current form of franchise agreement for each franchised location to be developed under an ADA. For each franchised location under a Franchise Agreement executed pursuant to an ADA, we will approve the Site, and provide the site selection assistance, in accordance with such Franchise Agreement as summarized in this Item 11 and in Item 12. We generally do not own your premises and lease it to you. (See Sections 1.1 and 3.1 of ADA.)

What This Means (2025 FDD)
According to Beauty Bungalows's 2025 Franchise Disclosure Document, if you enter into an Area Development Agreement (ADA) with them, you are required to sign their then-current form of franchise agreement for each franchised location to be developed under the ADA. Additionally, you must sign Beauty Bungalows' ADA, which is included as Exhibit H to the FDD.
This means that as an area developer, you're not just signing one agreement. You're committing to signing a franchise agreement for each individual Beauty Bungalows location you plan to open within your designated development area. This ensures that each location operates under the standard franchise terms and conditions.
Furthermore, the FDD states that you will be required to open your additional units upon a set schedule that Beauty Bungalows determines, referred to as your "Development Schedule." Failure to meet this development schedule constitutes a default under your ADA, which could lead to the termination of your rights to develop additional franchises or the entire ADA. However, a default under the ADA will not automatically trigger a default of any existing Franchise Agreements you have with Beauty Bungalows.
