Can a Beauty Bungalows franchisee register a domain name containing the Marks?

Beauty_Bungalows Franchise · 2025 FDD

Answer from 2025 FDD Document

Franchisee may not separately register any domain name or any portion of a domain name containing the Marks or participate or market on any website or other form of electronic media (including social technology, social media and social networking platforms) using the Marks unless Franchisee first obtains written approval from Franchisor. Franchisee's general conduct on the Internet or other forms of electronic media, including Franchisee's use of the Marks or any advertising, is subject to the terms and conditions of this Agreement and any other rules, requirements or policies that Franchisor may identify from time to time. Subject to Section 9.02 below, Franchisee may use the Marks for advertising using social media, digital platforms, and Craigslist but must first obtain Franchisor's prior written approval, which shall not be unreasonably withheld, conditioned or delayed.

What This Means (2025 FDD)

According to Beauty Bungalows's 2025 Franchise Disclosure Document, franchisees are generally prohibited from independently registering domain names containing the Beauty Bungalows marks. The FDD states that franchisees "may not separately register any domain name or any portion of a domain name containing the Marks" without first obtaining written approval from Beauty Bungalows. This restriction is part of a broader reservation of rights by Beauty Bungalows to control its brand and online presence.

This policy reflects Beauty Bungalows's desire to maintain a consistent brand image and customer experience across all online channels. By centralizing control over domain names and online marketing, Beauty Bungalows can ensure quality control and prevent franchisees from engaging in practices that could harm the brand's reputation. This is a common practice in franchising, where franchisors often exert significant control over marketing and branding to protect the overall system.

For a prospective Beauty Bungalows franchisee, this means that they cannot independently create a website with a domain name that includes "Beauty Bungalows" without express permission. While the franchisee can request approval, Beauty Bungalows retains the right to refuse. Franchisees are also subject to the terms and conditions of the franchise agreement and any other rules or policies Beauty Bungalows may implement regarding online conduct and advertising. Franchisees are allowed to use the Marks for advertising using social media, digital platforms, and Craigslist but must first obtain Franchisor's prior written approval, which shall not be unreasonably withheld, conditioned or delayed.

This policy extends to all forms of electronic media, including social technology, social media, and social networking platforms. Franchisees must adhere to Beauty Bungalows's guidelines and obtain prior written approval before using the Beauty Bungalows marks in any online presence. This ensures that all online marketing efforts align with Beauty Bungalows's overall strategy and brand standards.
