What This Means (2025 FDD)

According to Beauty Bungalows's 2025 Franchise Disclosure Document, Item 15 outlines the franchisee's obligation to participate in the actual operation of the franchise business. This section specifies that if the franchisee is a business entity, all officers, directors, shareholders, partners, members, and individuals owning 5% or greater interest must sign a Guaranty and Assumption of Franchisee's Obligations, agreeing to fulfill all obligations and comply with restrictions under the Franchise Agreement. Spouses of the franchisee, even if not directly involved in the business, must also sign this document.

The FDD also clarifies the employment relationship within the Beauty Bungalows franchise. All employees hired for the Beauty Bungalows franchise are solely the franchisee's employees and are not considered employees of Beauty Bungalows Franchising, LLC. The franchisee is responsible for all employment-related obligations, including insurance coverage, taxes, withholdings, employee benefits, and workers' compensation. Beauty Bungalows does not have the power to hire or fire the franchisee's employees.

Furthermore, the franchisee is solely responsible for all hiring and employment decisions, including training, remuneration, compliance with wage and hour requirements, personnel policies, benefits, recordkeeping, supervision, and discipline of employees. Any guidance provided by Beauty Bungalows on employment policies is merely exemplary, and franchisees should consult with local legal counsel experienced in employment law to establish their own employment policies. This ensures compliance with local regulations and protects both the franchisee and Beauty Bungalows from potential legal issues.
