What This Means (2025 FDD)
According to Beauty Bungalows' 2025 Franchise Disclosure Document, the term 'contact' in relation to a 'Lead' refers to the various ways the franchisor may interact with potential franchisees. A 'Lead' is defined as someone who has contacted, or been contacted by, Beauty Bungalows (or their representatives) about potentially purchasing a franchise for a new market area or territory. This also includes leads located in Beauty Bungalows' contact management system (CMS). However, existing Beauty Bungalows franchisees are excluded from the definition of a 'Lead'.
The FDD specifies that 'contact' can occur through several channels. These include in-person meetings, written correspondence, email exchanges, telephone conversations, or interactions within the Beauty Bungalows' contact management system (CMS). This broad definition ensures that any form of communication between Beauty Bungalows and a potential franchisee is considered a 'contact' for the purposes of determining Lead Fees.
The Lead Fee is designed to compensate Beauty Bungalows for the resources they invest in attracting and identifying potential franchisees. However, this fee does not apply if Beauty Bungalows directly shares a Lead with a franchisee before having significant contact with that Lead themselves. This provision encourages franchisees to leverage leads independently, without incurring additional fees, provided Beauty Bungalows has not already engaged substantially with the lead. Understanding this definition of 'contact' is crucial for franchisees to avoid unexpected Lead Fees and to effectively manage their interactions with potential new franchisees.
